In Defending a criminal matter the first step is to assemble a team of two or more attorneys which are hand picked based on their relative skills, experience, reputation and good character. The next step is to review the law you are charged with violating and the conduct of the police or federal agents in the matter to determine if there is a violation of the Federal and State Constitution. If the law or conduct is valid the next step is to review the facts of the case to determine how they apply under the law and other court decisions containing similar facts. If the facts are not in your favor under the case law then the next step is begin to prepare for a plea negotiation and sentencing. Lastly, if the facts are in your favor the next step, assuming the client agrees, is to try the case before a judge or a jury. Defending Criminal matters provides the trial experience which is needed to have an advantage in Civil matters and Civil Rights Matter where matters routinely settle as opposed to going to trial.
