I apply an honest approach in relation to Federal Criminal Defense. It is very simple, generally you have two options, Plead Guilty or Go to Trial. Some people have the rare option of cooperation but generally pleading guilty and accepting responsibility is usually in your best interest and will result in a lower guideline range and sentence. When the DOJ has indicted you that means they have picked a winner and statistically it is very very difficult to win as a Defendant against the Federal Government. As a result, it is very foolish to go to trial and so most federal cases result in a plea given the process the DOJ uses to indict and the rareness with which they make a mistake. In most cases, our time should be spent on sentencing issues which I have successfully been able to overcome the government on in numerous matters. However, In some rare cases there are motions to suppress, constitutional challenges, other reasons someone cannot plead guilty and must go to trial, Those are the rare 1%, not the bikers, but the people whom have done the impossible and defeated the federal government.
